Project Timeline

Project timelines are estimates based on normal conditions. We are not liable for delays caused by:

  • Unforeseen site conditions
  • Client-requested changes
  • Supplier delays
  • Force majeure events

Payment Terms

Payment terms will be specified in your service agreement. Typically:

  • Design services: 50% upon commencement, 50% upon completion
  • Installation projects: Deposit required, progress payments, final payment upon completion
  • Maintenance services: Monthly or quarterly billing as agreed

Late payments may incur interest charges at the rate of 8% above the Bank of England base rate.

5. Warranties and Guarantees

Plant Guarantee

We guarantee plants installed by us for one full growing season, subject to:

  • Proper care and maintenance as instructed
  • Adequate watering during establishment
  • Normal weather conditions
  • No damage from pests, disease, or third parties

Workmanship Guarantee

We guarantee our workmanship for a period of 12 months from project completion. This guarantee covers defects in installation but does not cover:

  • Normal wear and tear
  • Damage caused by misuse or neglect
  • Modifications made by others
  • Natural settling of materials

6. Client Responsibilities

As a client, you are responsible for:

  • Providing accurate information about your property and requirements
  • Ensuring site access for our team and equipment
  • Obtaining necessary permissions or permits
  • Notifying us of underground utilities or services
  • Following care instructions for plants and installations
  • Making timely payments as agreed

7. Cancellation and Refunds

Cancellation by Client

You may cancel services subject to the following:

  • Design services: Cancellation after work has commenced results in charges for work completed
  • Installation projects: Cancellation after materials ordered or work begun may result in charges for materials, labor, and lost profit
  • At least 48 hours notice required for scheduled appointments

Cancellation by Us

We reserve the right to cancel or suspend services if:

  • Payment terms are not met
  • Site conditions are unsafe
  • You breach these terms
  • Circumstances beyond our control prevent service delivery

8. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, consequential, or incidental damages
  • Our total liability is limited to the amount paid for the specific service
  • We are not liable for damage to underground utilities not marked or disclosed
  • We are not liable for plant failure due to factors beyond our control

Nothing in these terms excludes our liability for death or personal injury caused by our negligence or for fraud.

9. Insurance and Indemnity

We maintain appropriate public liability insurance. You agree to indemnify us against any claims arising from:

  • Inaccurate information you provide
  • Failure to disclose underground services
  • Your breach of these terms
  • Third-party claims related to your property

10. Disputes and Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

We encourage resolution of disputes through negotiation. If a dispute cannot be resolved amicably, mediation may be considered before pursuing legal action.

11. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

12. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
